Bill Kilberg — Bill is the most senior partner in Gibson Dunn's Labor & Employment Law Practice Group. He is a member of both the Executive and Management Committees of the Firm, and has served as Partner-in-Charge of the firm's Washington, D.C. office. Bill is former Solicitor for the U.S. Department of Labor, and also served as Associate Solicitor of Labor for Labor Relations and Civil Rights, General Counsel of the Federal Mediation and Conciliation Service, and Special Assistant to Secretary of Labor George P. Shultz. Bill counsels and represents clients in all aspects of employee relations, labor relations, and employee compensation and benefits. He has appeared numerous times in trial courts on behalf of employers in class and collective actions under the myriad of employment laws, including ERISA, Title VII of the Civil Rights Act, and the Fair Labor Standards Act. Mr. Kilberg’s practice also includes advocacy before Congressional committees, the Departments of Labor, Justice, and the Treasury, the EEOC, the IRS, the NLRB, and the PBGC. In 2008, Mr. Kilberg was named as one of the Top Ten Leaders of the Pack: Employment Litigators in the nation by Human Resource Executive and Lawdragon. Eugene Scalia — Gene is Co-Chair of Gibson Dunn’s Labor and Employment Practice Group and Chair of the Administrative Law and Regulatory Practice Group. He returned to Gibson Dunn’s Washington, D.C. office in March 2003 after serving as Solicitor of the U.S. Department of Labor. Gene has a national labor and employment practice handling a broad range of matters including those involving the National Labor Relations Act, ERISA, sexual harassment and the anti-discrimination laws, and the many statutes administered by the Department of Labor. He is a leading authority on the Sarbanes-Oxley “whistleblower” provision. Gene has also handled a range of appellate and regulatory matters, with particular concentration in litigation involving federal administrative rulemaking. He was named the “Top Washington, D.C. Lawyer” in Employment Litigation by the Washington Business Journal in 2006. In January 2007, Gene was named by American Lawyer one of the 50 top litigators in the nation under age 45, and was named one of the 500 leading lawyers in the country in the annual “Lawdragon” survey. He is listed in Who’s Who in America and is identified as one of the District’s leading labor and employment lawyers in the Chambers USA Guide to Leading Lawyers for Business, and in the International Who’s Who Legal USA – Management Labour & Employment, 2006.
Baruch Fellner — Baruch founded Gibson Dunn’s occupational safety and health practice. The practice is recognized as one of the leading national OSHA practices especially in such areas as ergonomics litigation, challenges to OSHA regulations and OSHA fatality crisis management. Baruch was previously with the Solicitor’s Office of the Department of Labor as counsel for both Appellate Litigation and Regional Litigation for the Occupational Safety and Health Division. He also is the former Associate General Counsel of the Pension Benefit Guaranty Corporation. Baruch has extensive experience in federal civil litigation, including labor, pension, profit sharing, employee benefits and occupational health and safety. He is also a leading attorney authority on data-driven medicine related to musculoskeletal disorders. Baruch has been ranked as one of the Top Twenty employment lawyers in the District of Columbia by Chambers USA – America’s Leading Business Lawyers for the past four years, in which he is acknowledged for “inspiring incredible client confidence” and his “encyclopedic knowledge” of OSHA law. He has also been listed in the The Best Lawyers in America guide and 2007 SuperLawyers for Labor and Employment Law work.
Jason Schwartz — Jason is a partner with Gibson Dunn’s Labor and Employment Practice Group in the Washington, D.C. office. He practices primarily in the areas of labor and employment litigation, negotiations, and counseling, and was recently ranked as a leader in employment law counseling by The Legal 500 US. His practice includes the full range of labor and employment matters, including those involving wage-hour and discrimination laws, non-competition agreements and trade secrets, Sarbanes-Oxley and other whistleblower protection laws, the Employee Retirement Income Security Act (ERISA), and the Occupational Safety and Health Act (OSHA). Jason has litigated employment matters in state and federal courts and administrative forums throughout the country, as well as in arbitration, and has represented clients before federal, state and local regulatory agencies. Jason has also successfully tried several sensitive whistleblower matters for major national employers, and he recently prevailed in a precedent-setting Labor Department appeal of one of the first Sarbanes-Oxley whistleblower cases to proceed to trial. He also counsels local and national employers, presents employment law-related training programs, and negotiates employment and other related agreements.
