Munich partner Mark Zimmer is the co-author of “Hilfe für Hinweisgeber – Beweislastumkehr nach § 36 II HinSchG-RegE” published in the issue 17/2022 of the German publication NZA (Neue Zeitschrift für Arbeitsrecht), together with Benita Schwung. The article focuses on the new German Whistleblower Protection Act, which includes provision for a reversal of the burden of proof. It discusses the scope of this reversal as well as possible problems, and employers will be introduced to options of how to rebut the presumption of liability.
