Gibson Dunn Obtains Dismissal of Appeal to an Asylum Grant at the Board of Immigration Appeals

On April 19, 2018, Gibson Dunn secured an appellate victory in favor of its client, Kevin Barahona-Vanega. The Department of Homeland Security sought to reverse the Immigration Court’s grant of asylum by arguing that the client was not a member of a judge-created particular social group. The Board of Immigration Appeals affirmed the grant of asylum, finding that there was not “a sufficient basis to conclude that the Immigration Judge’s ultimate determination that the respondent was statutorily eligible for asylum was in error.”
