Partner Matt Axelrod and associate Lindsay Wardlaw were interviewed by Export Compliance Daily (subscription required) about the expected enforcement of the U.S. Bureau of Industry and Security’s new 50% rule.
Matt, the prior head of BIS export enforcement and current co-chair of Gibson Dunn’s Sanctions and Export Enforcement practice group, said that the BIS “enforcement team is going to be happy with this change.”
Lindsay noted that BIS enforcement of the rule could begin immediately without a grace period.
“I think it’s possible enforcement will not be harsh for violations in the week or two after the rule was released, because it does take industry time to adjust to new rules,” Lindsay said. “But I don’t think we can assume there’s a so-called grace period.”
