Partner Blake Estes is quoted in the Financial Times/Ignites article “Daly: SEC Looks to Protect ETF Issuers’ ‘Place in Line’” (subscription required), which discusses how the U.S. Securities and Exchange Commission is looking to address copycat fund filings to help protect the “place in line” of issuers of innovative exchange-traded funds. Blake said one solution would be to allow issuers to submit confidential drafts, similar to the draft registration program for initial public offerings, under which companies can work with staff for weeks or months before filing publicly.

Blake noted that the novel products that sponsors most want to keep confidential “are also probably the strategies that are in greatest need of public scrutiny.”
