Sean Feller Discusses Policy Areas That Benefits Attorneys Should Know in 2026 with Law360

Partner Sean Feller was quoted by Law360 (subscription required) in an article on five policy areas that benefits attorneys should keep an eye on in 2026. He noted that “you could see some policy developments around prescription drug costs and PBM regulation” in 2026.
In a separate Law360 (subscription required) article on policy moves from the second half of 2025 that benefits lawyers should know, Sean said that one major development with “a lot of energy behind it” was expanded access to “alternative assets,” including private equity, real estate, and cryptocurrency.
Another major policy development Sean noted was the changing positions on ERISA fiduciary duties from the U.S. Department of Labor, including in litigation.
“It’s kind of a picky litigation point, but the burden of proof in ERISA litigation, I think that’s a big deal,” Sean said.
