In an extensive interview with Law360 (subscription required) about President Trump’s executive order seeking to reduce regulatory obstacles to retirement plans investing in alternative assets such as private equity, real estate, and cryptocurrency, New York partner Shukie Grossman noted that “The democratization of private equity is a hot topic mainly because the private equity industry and its adjacencies have generated returns which by and large have exceeded public market returns.” He added: “The average investor has historically not had the same degree of access to these types of investment opportunities.”

The change is a positive development for the private equity industry, which will likely increase its assets “dramatically” as more investors gain access to the industry, said Shukie, and it could also be a positive development for investors, provided the investment in alternative assets “represents the right segment of a particular individual investor’s investment portfolio”—bearing in mind that these high-return investments are also higher-risk investments.
