Partner Jamie France is quoted in Global Competition Review’s (subscription required) “Second Request Overhaul Seals Shift From Biden-Era Probes, Lawyers Say,” which discusses the U.S. Federal Trade Commission’s updating the agency’s rules to give staff greater flexibility when negotiating modified second requests.

Jamie noted that while FTC staff previously considered several factors including the competitive issues involved and the relative burdens of producing the requested information, the codification of these factors provides additional clarity. “It is important for parties to engage the FTC under this framework because it provides for these more explicit avenues for getting a second request modification granted,” she said. “It’s helpful to parties that this is more explicitly codified because they can really lean on the factors more in the written requests for a modification.”
