Ben Nichols

Ben Nichols is an associate in Gibson Dunn's New York office. Ben practices in Gibson Dunn’s Intellectual Property Practice group, where their practice focuses on complex patent litigation matters. Ben represents both plaintiffs and defendants in cases involving a range of computer and life sciences technologies, including microprocessors, servers and networking technologies, and genetic testing. Ben’s experience spans nearly all phases of litigation, from initial complaint through trial. Ben’s responsibilities have included preparing trial materials and witnesses, drafting dispositive motions, coordinating and drafting expert reports, drafting claim construction briefs, and handling all aspects of fact discovery. Ben has worked on a variety of legal issues, including infringement, anticipation, obviousness, invalidity under 35 U.S.C. § 112, inequitable conduct, and willfulness.

Prior to joining Gibson Dunn, Ben was member of the team that secured a $57 million verdict for Ravgen, Inc., a biotech firm that invented revolutionary, non-invasive prenatal testing technology. Ben also was part of a trial team that won a full non-infringement verdict on behalf of Cisco Systems, Inc., defeating a claim for more than $370 million and treble damages.

Ben graduated from Penn Law in 2021, where they were an editor for the Penn Law Journal of Law and Innovation. Prior to law school, Ben received a B.S. in Astronomy and a B.A. in History from the University of Maryland.
