Courtney L. Spears

Associate Attorney

Courtney Spears is an associate in the Orange County office of Gibson Dunn. She currently practices in the firm’s Litigation Department. Courtney represents clients in a wide range of high-stakes, complex commercial cases, with an emphasis in antitrust and competition and technology and intellectual property matters. She has extensive trial experience, having been a core member of four trial teams in the past two years.

Courtney’s representative matters include:

  • Representation of Rimini Street, a leading software support services provider, in copyright, false advertising, and unfair competition litigation against Oracle in the District of Nevada. Represented Rimini Street in two trials in connection with this matter, which is ongoing.
  • Representation of Merck & Co., Inc. at trial in In re Zetia (Ezetimibe) Antitrust Litigation (E.D. Va.), where plaintiffs alleged an unlawful agreement and conspiracy to delay generic competition. A settlement of the multidistrict litigation was reached during trial, and litigation concerning the opt-out plaintiffs is ongoing.
  • Representation of Hewlett Packard Enterprise Co. against claims of copyright infringement, tortious interference, and unfair competition brought by Oracle in a lawsuit relating to a subcontractor’s handling of components of an Oracle Operating System. After a three-week jury trial, the parties settled on confidential terms.
  • Representation of Big Fish Entertainment and REELZ against copyright infringement, trademark infringement, and unfair competition claims brought by A&E in connection with On Patrol: Live. A confidential settlement was reached after the close of discovery.
  • Representation of Energizer Holdings, Inc. in three related antitrust class action lawsuits alleging a price-fixing conspiracy with respect to the wholesale and retail sale of disposable batteries in the United States. The cases are currently in discovery with a trial scheduled for 2028.
  • Representation of Amgen Inc. in an antitrust action filed by a competitor alleging monopolization of the market for certain cholesterol reducing medications through the use of bundled discounts. This matter is ongoing, and trial is scheduled for May 2025.
  • Representation of HP Inc. in an antitrust class action alleging that HP monopolized the market for replacement ink through the use of firmware updates. This matter is currently in discovery.

Prior to joining Gibson Dunn, Courtney served as a law clerk to the Honorable Ronald
S.W. Lew of the United States District Court for the Central District of California.

Courtney earned her Juris Doctor in 2019 from the University of Southern California Gould School of Law. While in law school, Courtney served as a Senior Copy Editor for the Southern California Interdisciplinary Law Journal. Courtney graduated magna cum laude from the University of San Diego with a Bachelor of Arts degree in Political Science.

Courtney is a member of the State Bar of California and is admitted to practice before the United States District Courts for the Central and Northern Districts of California.
