Partners Josh Krevitt and Stuart Rosenberg recently secured the dismissal of a lawsuit against Uniswap Labs. As reported by the New York Law Journal (subscription required), the developers behind the Uniswap protocol were accused of infringing blockchain-based automated market maker technology. A federal judge ruled that the cryptocurrency patents are directed to abstract ideas and therefore ineligible for protection under federal law.
“The court held not only that Bancor failed to state a claim of infringement against Uniswap Labs and the Uniswap Protocol, but also that Bancor’s patent claims are invalid because they are ineligible under the Supreme Court’s Alice test,” Josh and Stuart said in a statement. “Gibson Dunn has litigated the Alice test successfully in dozens of other cases and industries since arguing and winning the Alice case itself at the Supreme Court in 2014, and we are pleased to have done so here for Uniswap Labs in the context of DeFi.”
