After a decade of litigation battles over how gig economy workers should be classified, partner Theane Evangelis says the legal landscape has shifted decisively. Speaking to Law.com (subscription required), Theane explains that recent legal and political developments have cemented their status as independent contractors.

Theane, who has represented Uber and other gig economy companies in challenges to their workers’ status, pointed to the settlement in Massachusetts and the California public vote on Proposition 22 as clear signals that both the law and public opinion are aligning in favor of driver independence. “Plaintiffs’ lawyers have completely failed to achieve their goal of making gig workers employees, and failed to achieve that anywhere. And it’s not surprising, because that’s not what anyone wants,” she said.

She continued: “The settlement in Massachusetts, for example, enshrines the independence of drivers. That is a win for Uber. And after that case, the settlement made permanent the independent status of drivers.”
