Samuel G. Liversidge is a partner in Gibson, Dunn & Crutcher's Los Angeles office. He is a member of the firm's Litigation Department and its Antitrust and Class Action Practice Groups. Mr. Liversidge has extensive experience in a broad range of business litigation. The focus of his practice is class action and unfair competition litigation. Mr. Liversidge has defended antitrust suits and consumer class actions in a number of different industries and across a wide range of products and services. His class action experience includes the successful defense of one of the nations largest high-tech companies at trial in a consumer class action alleging fraud and deception.
Mr. Liversidges representative matters include:
- representation of Hewlett-Packard Company in Hughes v. Hewlett-Packard Co., 01 CVS 00046 (Superior Court of North Carolina, Orange County), where HP obtained a complete defense verdict in one of the first consumer class actions tried under North Carolinas consumer protection statutes;
- representation of Hewlett-Packard Company in Stevens v. Hewlett-Packard (Superior Court of California, County of Riverside), where HP successfully opposed class certification and obtained summary judgment in a proposed nationwide class action alleging fraud and deception under Californias consumer protection statutes;
- representation of American Airlines in United States v. AMR Corp., 140 F. Supp. 2d 1141 (D. Kan. 2001), affd, 335 F.3d 1109 (10th Cir. 2003), where American obtained summary judgment in a major predatory pricing and monopolization case brought by the United States Department of Justice;
- representation of MiniMed Inc. in Infusion Resources, Inc. v. MiniMed Inc., No. 99-CV-771-C (E.D. La. 2002), affd, 351 F.3d 688 (5th Cir. 2003), where MiniMed obtained summary judgment in a Robinson-Patman Act and unfair competition case;
- representation of Hewlett-Packard Company in Jones v. Hewlett-Packard (Superior Court of California, County of San Francisco), where HP obtained summary judgment in a nationwide class action alleging tying under Californias Cartwright Act and fraud and unfair competition under Section 17200 of Californias Business & Professions Code.
- representation of Hewlett-Packard Company in Freeman v. Hewlett-Packard (Superior Court of California, San Jose), where plaintiffs voluntarily dismissed a class action under Californias UCL and Consumer Legal Remedies Act following several rounds of demurrers.
- representation of Hewlett-Packard Company in consumer class actions filed in California, Texas and South Carolina in which plaintiffs alleged that HP and other computer manufacturers misrepresented the hard drive capacity of certain computers and other devices containing hard drives. A favorable settlement was achieved in each action.
- representation of Hewlett-Packard Company in Hurkes Harris Design Assoc. v. Hewlett-Packard (Superior Court of California, San Jose), where plaintiffs brought a consumer class action under California's UCL alleging that HP knowingly marketed and sold defective hard drives pre-installed in certain of its computers. A favorable settlement was achieved in the action.
- representation of Tenet Healthcare Company in a series of class actions filed across the country alleging that the pricing practices employed at Tenets subsidiary hospitals violated various consumer protection statutes. A favorable settlement was achieved.
- on-going representation of Hewlett-Packard Company in HP Inkjet Printer Litigation (N.D. Cal.), where plaintiffs have brought a nationwide class action for fraud and deceit based on HPs utilization of certain ink gauge technology in its inkjet printers and related cartridges.
- on-going representation of Hewlett-Packard Company in Rich v. Hewlett-Packard (N.D. Cal.), where plaintiffs have brought a nationwide class action under Californias UCL challenging the underprinting technology employed by HP in certain of its inkjet printers and cartridges.
Mr. Liversidge received his law degree magna cum laude in 1995 from Pepperdine University, where he was a member of the Pepperdine University Law Review. Mr. Liversidge earned his bachelor of arts degree summa cum laude in 1992 from Andrews University.
