Texas Business Taxpayer Amnesty Program Approaching

Texas Comptroller Susan Combs recently announced a two-month "fresh start" amnesty period, during which Texas businesses may file past due reports and pay certain delinquent state and local taxes or fees without paying penalties or interest.  Taxpayers participating in the program may also amend previously filed reports that underreported taxes for any reason, including erroneously claiming credits or deductions.  The amnesty program applies to all tax periods for which the original tax return was due prior to April 1, 2012.

The amnesty period will run from June 12 through August 17 and applies to sales taxes, franchise taxes, and any other fees administered by the Comptroller’s office.  The amnesty does not apply to gross receipt assessments for the Public Utility Commission, to underpaid tax returns (i.e., tax that was reported but not paid), or to filing periods under audit or examination.  Amnesty reports and payments must be submitted via paper return and should be clearly marked "Amnesty."
