Gibson Dunn Secures Dismissal of Patent Infringement Lawsuit Against Client NetApp

On September 22, Gibson Dunn secured a major victory for client NetApp when U.S. District Judge Rodney Gilstrap granted the company’s motion to dismiss for improper venue in a six-patent infringement suit brought by Valtrus Innovations and Key Patent Innovations in the Eastern District of Texas. Judge Gilstrap agreed that venue was improper, rejecting plaintiffs’ arguments that NetApp’s remote employees, coworking arrangements, and an authorized reseller established proper venue in the district.
