Carson Whitehurst

Associate Attorney

Carson Whitehurst is a litigation associate in the New York office of Gibson Dunn.

His practice focuses on high-stakes commercial litigation, including securities, appellate, regulatory, and bankruptcy-related matters. Carson has represented public and private companies, investment firms, and individuals in matters involving claims of fraud and civil RICO violations, breach of contract, valuation and solvency disputes, and enforcement of restrictive covenants in federal, state, and bankruptcy courts.

Select representative matters include:

• Representing a former managing director of a leading investment bank through a complete summary judgment victory in a civil RICO action in the Southern District of New York seeking approximately $1 billion in damages.

• Representing a former chief executive officer and an affiliate in securing a $26 million judgment on the eve of trial in litigation against a prestige color cosmetics company in Delaware Superior Court and in defending the judgment in a pending Delaware Supreme Court appeal.

• Representing an administrative agent for bespoke collateralized loan obligations through summary judgment and a weeklong bench trial in the Southern District of New York in long-running litigation regarding the agent’s fees, expenses, and discretionary authority.

• Representing, pro bono, the Giffords Law Center to Prevent Gun Violence, the State of California, and parents of children lost to ghost gun violence in securing summary judgment in the Northern District of California in an administrative law action compelling the federal Bureau of Alcohol, Tobacco, Firearms and Explosives to regulate AR-style “ghost guns,” and in defending the judgment in a pending Ninth Circuit appeal.

Carson earned his Juris Doctor, cum laude, in 2022 from New York University School of Law, where he was a Robert McKay Scholar and a Development Editor of the Annual Survey of American Law. While in law school, Carson served as a civil litigation intern with the U.S. Attorney’s Office for the Southern District of New York. He received his Bachelor of Arts in Government and History, summa cum laude, from the College of William & Mary in 2019.

Carson is admitted to practice law in the State of New York and before the United States District Courts for the Southern and Eastern Districts of New York.
