Law360 (subscription required) quoted a statement by partner Ted Boutrous, who is part of the Gibson Dunn team representing RealPage in its lawsuit against New York’s attorney general. The property management software company alleges that a recently passed state law that prevents building owners from using software to collude on residential rental rates is unnecessary and violates the First Amendment.

In the statement, Ted said that the law is a misguided effort to manage rental prices that impedes his client’s right to offer advice and recommendations and that “New York legislators should propose real solutions to housing affordability issues instead of banning constitutionally protected speech.”
