In their statistical review of the Texas Supreme Court’s 2024–2025 term for The Texas Lawbook, partner Allyson Ho and associates Elizabeth Kiernan and Catherine Frappier take a deep dive into the Court’s numbers — it affirmed in 27.7% and reversed in 72.3% of the cases in which it heard argument and issued a decision — and provide an overview of how many cases the Court heard from each Texas court of appeals and a breakdown of how each court of appeals fared.
Their conclusion: while affirmance rates in the various courts of appeals continue to fluctuate, “the conventional wisdom that it’s better to be in the petitioner’s shoes on a granted and argued case remains true.”
