Gibson Dunn’s Supreme Court Immigration Win Highlighted by The Texas Lawbook

The Texas Lawbook has featured a Gibson Dunn team’s partial victory in the U.S. Supreme Court in a significant immigration case.

Associate Stephen Hammer was appointed by the Supreme Court to brief and argue in support of the decision of the U.S. Court of Appeals for the Fourth Circuit after the U.S. Department of Justice declined to defend it. In a 5-4 decision, the Supreme Court adopted Gibson Dunn’s argument that the 30-day deadline to petition for review of a final order of removal is triggered when certain expedited removal orders are issued — not when later proceedings seeking withholding of removal conclude.

The Court also held unanimously that the 30-day deadline is not jurisdictional and can therefore be waived by the government.
