Michael Walther is a German-qualified partner in the Munich office of Gibson, Dunn & Crutcher LLP. He is a member of the firm’s Antitrust, Intellectual Property and White Collar Defense and Investigations Practice Groups.
Mr. Walther advises German and international companies on European and German antitrust and competition law. Many of his clients are active in technology-driven industries, for example high technology, telecommunications, biotechnology and pharmaceutical companies. Mr. Walther advises his clients on all aspects of domestic and international antitrust issues, including merger control, market dominance, defense in cartel investigations, and complex transactions involving acquisitions, joint venture scenarios and various forms of cooperation within industry. Through his long-standing practice, he has extensive experience in dealing with the German Federal Cartel Office, the European Commission, and with various national competition authorities worldwide.
Mr. Walther also has a strong focus in white-collar defense and regulatory compliance advice, in particular concerning the prevention and detection of various types of banned business practices such as cartels, abuse of market power, corruption, fraud and bribery. This includes, in addition to internal audits and investigations, the creation and implementation of antitrust compliance programs. He has particular expertise in international and German law aspects of anti-corruption law, including the U.S. Foreign Corrupt Practices Act (“FCPA”) and the UK Bribery Act. He has conducted internal investigations relating to businesses in several European countries and in Asia, and is a member of an international team of attorneys assisting the U.S. Independent Counsel to the first non-U.S. Compliance Monitor in connection with the largest FCPA settlement ever.
Mr. Walther regularly writes on antitrust and related subjects. His latest publications include, “Standardisierungs-Kooperationen und Kartellrecht” (“Standard-Setting Bodies and Antitrust Law”), published in the German competition and antitrust magazine Wirtschaft und Wettbewerb (WuW), Volume 58, Issue 2, and “The UK Bribery Act and its implications on German companies”, published in RIW 04/2011.
Clients have recommended Mr. Walther as an “Antitrust and IT specialist” and an “outstanding personality”. He is ranked as one of the leading lawyers in for EU and Competition in Germany by Legal Experts EMEA 2013 and for Competition/Antitrust in Germany by Best Lawyers (2010-2013). In addition, the JUVE Handbook continuously ranks Mr. Walther and his team among the leading Antitrust practices in Germany. The 2011/2012 edition of the JUVE Handbook also recommends the Munich office’s White Collar Defense and Investigation team in the category ‘Compliance Investigations’.
Before joining Gibson Dunn, Mr. Walther was partner in a renowned international German law firm where he was chair of the antitrust practice group.
